This Promotion is sponsored and administered by Deckmasters Supply Store, Fargo, North Dakota (“Sponsor”). Happy Harry’s Bottle Shop is not a sponsor, administrator, or responsible party for this Promotion.

Promotion Description

​

The Happy Harry’s Backyard Party Giveaway (the “Promotion”) is a promotional sweepstakes offering one (1) 14x14 Great Plains Pergola materials package to an eligible entrant selected at random in accordance with these Official Rules. This Promotion is intended to comply with all applicable federal and North Dakota laws governing promotional sweepstakes and is not a raffle, lottery, or gambling activity.

Eligibility

The Promotion is open only to legal residents of the United States who are age 21 or older at the time of entry and who reside within a 40-mile radius of Fargo-Moorhead. Employees, officers, directors, agents, and immediate family members (spouse, parent, sibling, child, or household member) of Sponsor are not eligible. Sponsor reserves the right to verify eligibility.

Entry Period

The Promotion begins on the date the pergola display is installed at Happy Harry’s Bottle Shop and ends at 11:59 PM Central Time on July 31 (the “Entry Period”). Entries received outside of the Entry Period are void.

​

How to Enter

Eligible participants may enter by scanning the official QR code and completing the online entry form or by completing an official paper entry form at the Deckmasters Supply Store, located at 5507 53rd Ave S, Fargo, ND 58104 . Limit one (1) entry per person. No purchase or payment of any kind is required to enter or win. Incomplete, inaccurate, or fraudulent entries may be disqualified.

Grand Prize

One (1) prize will be awarded. The prize consists of one (1) 16x16 Great Plains Pergola Kit (materials only). Installation, permits, electrical work, site preparation, and modifications are not included. The Approximate Retail Value (ARV) of the prize is $14,500, representing Sponsor’s standard retail price for this materials package as of the Promotion start date. The prize is non-transferable, has no cash value, and may not be exchanged or substituted.

Winner Selection

The winner will be selected in a random drawing conducted by Sponsor within five (5) business days after the end of the Entry Period. Odds of winning depend on the number of eligible entries received.

 

Winner Notification and Claim Requirement

The selected winner will be notified by phone and/or email using the contact information provided at entry. The winner must respond within thirty (30) calendar days of notification and complete all required documentation, including providing a completed IRS Form W-9. Failure to respond or provide required documentation within 30 days will result in forfeiture of the prize. Sponsor may then select an alternate winner, who will also have 30 days to claim the prize.

 

Taxes

The winner is solely responsible for all federal, state, and local taxes associated with acceptance and use of the prize. Sponsor will report the Fair Market Value (ARV) of the prize to the Internal Revenue Service as required by law and will issue an IRS Form 1099-MISC if applicable. Failure to provide required tax documentation may result in forfeiture of the prize.

Construction and Site Conditions

The prize consists of materials only. Sponsor makes no representation or warranty regarding site suitability, soil conditions, utility access, permitting requirements, homeowner association approvals, or installation labor. The winner is responsible for all installation costs and regulatory compliance.

Marketing Consent

By entering the Promotion, entrants consent to receive communications from Sponsor regarding this Promotion and future products, services, and promotions via email, phone, SMS, or mail. Entrants may unsubscribe from marketing communications at any time in accordance with applicable law.

 

Privacy

Personal information collected in connection with this Promotion will be used for administration of the Promotion, prize fulfillment, and marketing communications. Sponsor will not sell entrant information to third parties and will handle personal data in accordance with applicable privacy laws.

Publicity Release

Except where prohibited by law, the winner grants Sponsor the right to use the winner’s name, likeness, voice, and hometown for promotional purposes without additional compensation.

Limitation of Liability

​

By participating, entrants release and hold harmless Sponsor and Happy Harry’s Bottle Shop, and their respective officers, employees, and agents, from any liability arising from participation in the Promotion or acceptance, use, or misuse of the prize. Sponsor is not responsible for technical failures, lost or delayed entries, unauthorized access, or electronic errors.

Dispute Resolution

​

Any dispute arising from this Promotion shall be governed by the laws of the State of North Dakota. All disputes shall be resolved exclusively through binding arbitration conducted in Fargo, North Dakota. Entrants waive any right to participate in a class action.

​

Modification or Cancellation

Sponsor reserves the right to cancel, modify, or suspend the Promotion if circumstances beyond its control compromise its integrity, including but not limited to acts of God, natural disasters, government orders, or system failures.

Severability

​

If any provision of these Official Rules is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

​

Void Where Prohibited

This Promotion is void where prohibited by law.
